County Description

Shasta County, officially the County of Shasta, is a county located in the northern portion of the U.S. state of California. As of the 2010 census, the population was 177,223. The county seat is Redding. Shasta County comprises the Redding, California Metropolitan Statistical Area. The county occupies the northern reaches of the Sacramento Valley, with portions extending into the southern reaches of the Cascade Range.

Shasta County was one of the original counties of California, created in 1850 at the time of statehood. Parts of the county’s territory were given to Siskiyou County in 1852, and to Tehama County in 1856.

CULTIVATION

Cultivation: (Approved) 17.88.320 MEDICAL MARIJUANA CULTIVATION

Cultivation of more than twelve (12) Marijuana plants on any Premises is prohibited. The foregoing limitation shall be imposed regardless of the number of Qualified Patients or Primary Caregivers residing at the Premises or participating directly or indirectly in the Cultivation. Further, this limitation shall be imposed notwithstanding any assertion that the person(s) cultivating marijuana are the Primary Caregiver(s) for Qualified Patients or that such person(s) are collectively or cooperatively cultivating marijuana

Cultivation within a Residence or any other structure used or intended for human occupancy is prohibited.

  • 3. Outdoor Cultivation on any Premises is prohibited.
  • 4. Cultivation may only occur on a Premises within a detached residential accessory structure affixed to the real property (a) that meets the definition of “Indoor,” or “Greenhouse,” (b) that is located on the same Premises as the Residence of a Qualified Patient(s) or a Primary Caregiver(s), and (c) that complies with all of the provisions of the Shasta County Code relating to accessory structures including, but not limited to, the County’s General Development Standards in Chapter 17.84, and Section 17.88.140 of the Shasta County Code. Where the provisions of this Section are more restrictive than Shasta County Code Chapter 17.84 and Section 17.88.140, the provisions of this Section shall govern.

Ordinance No. SCC 2016-01

Subsection (D) of Section 17.88.320 of the Shasta County Code is amended to add the following provisions to the existing provisions of that subsection:

  • 14. Cultivation shall be subject to the following permitting requirements:
    • a. Cultivation shall only occur after the issuance of a zoning permit, in accordance with Shasta County Code section 17.92.060. Cultivation without a valid zoning permit is prohibited.

Section 8.05.040 Unlawful sale, purchase, and handling of butane

  • A. It is unlawful for any reseller to sell, offer to sell, or distribute to a customer in the unincorporated area of the County of Shasta any number of butane canisters that exceed a combined total storage quantity of 600 ml of butane during a single transaction.
  • B. It is unlawful for any person that is not a reseller or wholesaler to have in their possession, custody or control in the unincorporated arca of the County of Shasta any number of butane canisters that exceed a combined total storage quantity of 600 ml of butane at any one time.
  • C. It is unlawful for any customer to purchase or acquire per calendar month in the unincorporated area of the County any number of butane canisters that exceed a combined total storage quantity of 600 ml of butane, whether sold individually or by the package.

17.88.310 MEDICAL MARIJUANA Dispensaries Prohibited

Medical marijuana dispensaries are prohibited in all zones of the county and no permit or approval of any type shall be issued therefor.

Medical Marijuana Deliveries, Section 17.88.315 ORDINANCE NO. SCC 2016-01

AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SHASTA ADDING SECTION 17.88.315, MEDICAL MARIJAANA DELIVERIES AND AMENDING SECTION 17.88.320, MEDICAL MARIJUANA CULTIVATION oF CHAPTER 17.88, SPECIAL USES

  • Section I 17.88.315 MedicalCannabisDeliveries
    • B. The delivery by any dispensary of medical cannabis or medical cannabis products to a qualified patient or primary caregiver is prohibited.
    • C. The transfer of medical cannabis or medical cannabis products by any person to a qualified patient or primary caregiver is prohibited.
    • D. The provisions of this section shall not apply when both of the following requirements are met: (1) The transfer of medical cannabis or medical cannabis products is authorized under Shasta County Code section 17.88.310; and (2) the transfer is between qualified patients and primary caregivers who are exempt from the licensure requirements of Chapter 3.5 of Division 8 of the Business & Professions Code (commencing at Business & Professions Code section 19300), pursuant to Business & Professions Code section 19319.
