City Description

Grover Beach is a city in San Luis Obispo County, California, United States with an estimated population of 13,505. Grover Beach was originally known as Town of Grover, which was founded on August 1, 1887. The town was named for its founder, D.W. Grover.

Although Grover Beach currently maintains a temporary ban on all commercial and medical cannabis activity within the city. A public hearing was conducted on May 15, 2017 which concluded with the adoption of both a land use ordinance and a regulatory ordinance which will allow for the establishment and operation of commercial medical cannabis businesses. Beginning June 14, 2017, Grover Beach will begin accepting Use Permit and Commercial Cannabis Permit applications for medical cannabis cultivation, manufacturing, testing laboratories, transportation, delivery, and distribution services and will be limited to the designated Industrial (I) zone. The Coastal Industrial (CI) and Coastal Industrial Commercial (CIC) zones will not become available until the Coastal Commission approves of a Local Coastal program (LCP) Amendment. Commercial Cannabis Permit applications for retail dispensaries will not be accepted until after a June 5, 2017 City Council meeting where Councilmembers will consider establishing a pre-application process for dispensary applications.

Grover Beach will tax commercial cannabis having voted in favor for Measure L-16 on November 8, 2016 and adopting the commercial cannabis tax ordinance on February 21, 2017.

Summary of proposed tax rate:

Commercial Medical Marijuana Activates: 5% tax on gross receipts.

Non-medical Commercial Medical Marijuana Activities: 10% tax on gross receipt.

Cultivation and Nurseries: $25 per sq ft on the first 5,000 sq ft and $10 per sq ft on the remainder.

Once the ordinance enacting the tax rate is adopted, the tax will not sunset and would be subject to annual CPI adjustments. The revenue generated by Measure L-16 would go to the City’s General Fund.

Any tax on non-medical (i.e., recreational) marijuana activities could only occur if the City adopted laws allowing the recreational use of marijuana.

Sec. 3151. Commercial Cultivation of Marijuana. Commercial Cultivation of Marijuana, as defined in Section 3152, shall not be a permitted use in any Zone in the City, and no Use Permit shall be issued to permit commercial cultivation of marijuana within City limits.
